1. Who we are

The Critique and Site Critique are products made by Brutally Human Studio, the trade name of Brutally Human LLC, a limited liability company registered in the State of New York. Brutally Human LLC is responsible for the personal information described in this policy. If you have a question about your data, you can always reach us at iam@brutallyhuman.com.

We built The Critique to help people be understood, so we try to collect as little about you as we can and to be plain about what we do with it. Your portfolio stays yours.

2. What we collect

When you run an audit. We collect the website address you submit, the perspective you choose (client or job seeker), and the email address you enter. We read the public pages of that site and store the report we generate, so you can return to it on the History page.

When you join the newsletter. We collect your email address and a record of your consent.

When you apply to be a critic. We collect your name, email address, current title, company or organization, professional role, location, years of experience, website, LinkedIn or X profile, short professional bio, your reasons for volunteering, and your portrait photo.

When you accept a Critique's Choice recognition. We collect your name, your site's address, an image of your site, and the details you agree to have published.

When you contact us. We keep the messages you send and the details you include in them.

Automatically. Like most websites, our servers record basic technical information, such as your IP address, browser type, the pages you visit and the time of your visit. This helps us keep the Services secure and running. We use cookies only to remember your previous audits, so you can open them again from the History page. We also use PostHog and Replit's built-in analytics to understand, in general terms, how people use the site.

3. How we use it

We use your information to:

  • run audits and deliver your reports;
  • show you your past audits;
  • send the newsletter, if you've asked for it;
  • review critic applications and publish the profiles of accepted critics;
  • review, publish and maintain Critique's Choice recognitions, with permission;
  • reply when you contact us;
  • understand, in anonymous and combined form, how sites perform across The Critique, which is where figures such as the average score come from;
  • improve the accuracy and fairness of our audits; and
  • protect the Services from abuse and comply with the law.

We don't sell your personal information, and we don't use it for third-party advertising.

4. AI-assisted audits

We use third-party service providers, including Replit and OpenAI, to generate website audits and recommendations. To provide this service, we transmit extracted website content, website addresses, and relevant audit inputs to these providers. Extracted content may include personal information published on the submitted website.

OpenAI states that data submitted through its API is not used to train its models by default, unless the API account holder explicitly opts in. Our service providers may process and retain data for service delivery, security, abuse prevention, and legal compliance in accordance with their applicable terms and data policies.

5. Who we share it with

We don't sell your data, and we don't share it with anyone else, apart from the companies that help us run the Services. They work on our behalf and are bound to protect your information. Those companies are Replit, which hosts the Services; OpenAI, which performs the analysis behind each audit; PostHog, which helps us understand how the site is used; and SendGrid, which sends our emails and newsletter. We may also share information if the law requires it, to protect our rights or the safety of others, or as part of a merger or sale of our business, in which case this policy would continue to protect it.

6. What becomes public

Most of what you give us stays private. Your audit report is private unless you choose to share it. The exceptions are the things you agree to make public:

  • Accepted critics. Your name, photo, bio, role, company, location, years of experience, website and LinkedIn or X profile appear in our directory. Your email address and your reasons for volunteering stay private.
  • Critique's Choice recognitions. Your name, your site, an image of it, the recognition and its date are published only with your permission.

7. How long we keep it

We keep information only as long as we need it for the reasons in this policy:

  • Audit results: we store them so you can come back to them from the History page. You can ask us to delete them at any time.
  • Newsletter details: until you unsubscribe.
  • Critic applications, whether or not they are accepted: indefinitely, until you ask us in writing to remove them, or until we decide to remove them.
  • Critic profiles and recognitions: until you ask us to remove them, or until we decide to remove them.

When we no longer need information, we delete it or make it anonymous.

8. How we protect it

We use reasonable technical and organizational measures to protect your information, including encrypted connections. No system is perfectly secure, so we can't guarantee absolute security, but we take the responsibility seriously and will tell you if a breach affects you, as the law requires.

9. Your choices and rights

You can ask us to show you the personal information we hold about you, correct it, delete it, or send you a copy. You can unsubscribe from the newsletter at any time using the link in any email, or by writing to us. You can withdraw a permission you gave us, such as a public critic profile or a recognition, and we'll take it down.

Depending on where you live, you may have additional rights. These include rights under the European Union and United Kingdom General Data Protection Regulation and under California privacy law, such as the right to object to certain processing or to complain to a data protection authority. To use any of these rights, email iam@brutallyhuman.com. We'll respond within the time the law requires, and we won't treat you differently for asking.

10. International users

Brutally Human LLC is based in the United States, and our providers may process information in the United States and other countries. By using the Services, you understand that your information may be transferred to and processed in those places, where the law may differ from the law where you live.

11. Age requirement

The Services are only for people who are 18 or older, and we don't knowingly collect information from anyone younger. If you believe someone under 18 has given us personal information, contact us and we'll delete it.

12. Links to other sites

Resources and other parts of the Services link to websites we don't control. Their own privacy policies apply when you visit them.

13. Changes to this policy

If we change how we handle your information, we'll update this policy and its effective date. If a change is significant, we'll make it clearly visible on the site or let you know by email.
